1. Definitions

1.1. 'Account' – a profile created by a user to access the Services.

1.2. 'Affiliate' – refers to Higgobay (Pty) Ltd's participation in marketing partnerships with licensed South African betting operators.

1.3. 'Personal Information' – has the meaning defined in the Protection of Personal Information Act 4 of 2013 (POPIA).

1.4. 'Services' – all websites, games, leaderboards, predictions, and other features offered under the BossPicks platform.

1.5. 'User', 'you', or 'your' – any person accessing or using the Services.

2. Duration

These Terms apply for as long as you use or remain registered on BossPicks.

3. Nature of Service and Affiliate Disclosure

3.1. BossPicks operates as an entertainment and information platform offering free-to-play sports prediction leaderboards, games, and challenges.

3.2. Affiliate Relationships: BossPicks participates in affiliate marketing programs and may include links to licensed South African sportsbooks or betting operators. When you click these links and sign up or place bets, we may receive a commission.

3.3. BossPicks is not a bookmaker. We do not accept or process bets, determine odds, or handle player funds.

3.4. We promote only operators licensed by provincial gambling boards in South Africa, and encourage responsible gambling.

4. Provision, Modification, and Discontinuation of Services

4.1. We reserve the right, in our sole discretion, to:

• Modify or enhance the Services;
• Limit, suspend, or terminate certain features; or
• Cease all operations of BossPicks entirely.

4.2. We may do so at any time and for any reason, including financial, commercial, or technical viability.

4.3. While we may attempt to provide notice where practical, we are under no legal obligation to continue operations or preserve user data once the service is discontinued.

4.4. We shall not be liable for any inconvenience, loss, or damage resulting from such suspension, modification, or closure.

5. Use of Services

5.1. You agree to use BossPicks lawfully and for its intended entertainment purpose.

5.2. You may not:

• Use automated tools or scripts to manipulate leaderboards;
• Create multiple accounts;
• Post or transmit offensive, defamatory, or illegal content.

5.3. We reserve the right to suspend or remove any account that violates these Terms.

5.4. BossPicks is currently in public Beta – some instability of the platform may be experienced. Please report any issues to support@bosspicks.co.za.

6. Registration and Account Security

6.1. You must be 18 years or older to register or use the Services.

6.2. You are responsible for keeping your login credentials secure and for all activity under your account.

6.3. If you suspect unauthorized access, notify us immediately.

7. Privacy and POPIA Compliance

7.1. We collect, store, and process personal information in compliance with the Protection of Personal Information Act (POPIA).

7.2. Information collected may include your name, email address, and engagement data, used to manage your account and improve the Services.

7.3. Business Sale, Merger, or Restructure:

If Higgobay (Pty) Ltd or BossPicks is sold, merged, acquired, or restructured, all user data, including names, email addresses, mobile numbers and related information will form part of the business assets transferred to the acquiring entity. That entity will be legally bound by equivalent data-protection standards under POPIA.

7.4. Your information will never be sold or rented to unrelated third parties.

8. Marketing and Communication

8.1. By registering, you agree to receive all transactional and service-related communications via email, SMS, or push notifications.

8.2. By selecting the "Send me promotions and marketing comms" option on registration, you agree to receive marketing communications via email, SMS, or push notifications.

8.3. You may opt out of marketing communications at any time by following the unsubscribe instructions in our messages or by contacting us directly.

9. Competitions, Leaderboards, and Promotions

9.1. Participation in BossPicks competitions is free and open only to South African residents aged 18+.

9.2. Prizes (where offered) will be detailed on each competition page and are non-transferable.

9.3. It will take up to 48 hours after the conclusion of the leaderboard period to finalise the results.

9.4. Winners will be contacted via their registered email address. Unclaimed prizes after 30 days after the end of the leaderboard period may be forfeited.

9.5. Winners may be asked to verify their South African identity. Failure to do so within 7 days will result in disqualification.

9.6. All leaderboard and competition outcomes are final after results have been finalised.

9.7. Data Accuracy and Corrections

While we take reasonable steps to ensure that all data associated with events, picks, scores, points, results, and leaderboard calculations are accurate, errors may occasionally occur due to technical or human mistakes. BossPicks does not guarantee that all data will be error-free at all times.

BossPicks reserves the right to correct any data identified as incorrect at any time before the results of a leaderboard period are finalised, without prior notice. These corrections are made solely to fix mistakes and reflect the accurate outcome of events and calculations.

Users may challenge the results with evidence, and if accepted by BossPicks, the results will be corrected.

Data corrections may result in a change of winners.

9.8. Provision of the Services

While BossPicks aims to provide the Services 24/7, it makes no guarantees on the Services availability and is not responsible for the consequences of its service being unavailable.

10. No Refund or Compensation

10.1. If BossPicks ever introduces paid features, subscriptions, or sponsored promotions, all payments made will be non-refundable, except where required by law.

10.2. If we suspend, modify, or discontinue Services, you will not be entitled to refunds, credits, or compensation, regardless of unused time or access.

10.3. By using or purchasing any feature, you waive all rights to claim damages or refunds if we cease operations for financial or commercial reasons.

11. Limitation of Liability

11.1. Your use of BossPicks is entirely at your own risk.

11.2. We are not liable for any loss, damage, or inconvenience arising from:

• Errors, interruptions, or discontinuation of Services;
• Data loss or unauthorized access;
• Affiliate links to third-party bookmakers;
• Any business decision to suspend or terminate operations.

11.3. BossPicks is provided 'as is' without warranties of any kind.

12. Termination

12.1. We may suspend or terminate any account or access to the platform at any time, with or without notice, for:

• Breach of these Terms;
• Fraudulent or abusive conduct; or
• Commercial or operational necessity.

12.2. We are under no obligation to maintain or restore any data following termination.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa.

You consent to the exclusive jurisdiction of the Western Cape High Court, Cape Town.
